Tips for (Successfully) Filing Limited Conservatorship - How to Avoid Common Problems

Limited conservatorships have their own set of specific procedures and practices.  In this presentation, those procedures and practices will be covered, including how to properly prepare the paperwork and shepherd the necessary documents, the role of court appointed counsel for the conservatee, the role of the Court Investigator, and practice tips from the bench.

About the Presenters: Judge Julie A. Emede, Nuala Bates, Mark Dames and Lorna Drope

Hon. Julie A. Emede, Superior Court of California, County of Santa Clara
Julie A. Emede was appointed to the bench in December 2009, and is currently assigned to the Probate Division. Prior to moving to Probate Court, she served in Family  Court for over five years, and was the Supervising Judge for more than three years. Before Family Court, she served in and supervised the dedicated Criminal Family  Violence court, handling all aspects of both misdemeanors and felonies from arraignment through trial, sentencing, and probation reviews.
 
Nuala Bates, Supervising Court Investigator for Santa Clara Superior Court

Nuala Bates is a graduate in law from Queen’s University, Belfast, she practiced as an attorney in Northern Ireland and England where she became a partner in the firm of Fentons, Solicitors, Manchester. After moving to the USA in 1994, she was admitted to the California State Bar and practiced in probate and family law. She received her MSW from Sacramento State University in 2008. Nuala began her employment with the Court Investigator’s Unit in 2012 and was promoted to Supervisor in 2018.

Mark Dames
Mark spent 31 years as a Public Defender and retired as Deputy Public Defender in December 2019. He has experience in over 100 trials from misdemeanors to homicides to civil cases. The last 10 years he was assigned to represent proposed and current conservatees in LPS (mental health) conservatorships, general conservatorships, and limited conservatorships. Additionally, he has 2 years experience in plaintiffs' personal injury litigation. Mark graduated in 1986 from Santa Clara Law School. He completed his undergraduate in 1981 at Santa Clara University with a B.A. in History.

Lorna J. Drope, Esq.
Lorna has been practicing law since 1995. She holds a Master of Laws in taxation, which she received cum laude from the University of San Diego in 2002. She is admitted to practice law in California, Nevada, and Arizona. Lorna opened her own practice in 2010, where her focus is working with families with loved ones with disabilities. She also works closely with Bay Area nonprofit organizations serving the special needs community. She is currently chairman of the board of directors of California Community Opportunities (CCO). She previously served as chairman of the board of directors for Angels on Stage and Special Kids Connect (SKC). In addition, she served on the board of directors of Pacific Autism Center for Education (PACE) and Life Services Alternatives (LSA).
