These days, it is becoming less and less common for new clients to arrive at your office with California-only estate planning needs.  While their California needs might be straight-forward, there are often foreign or cross-border needs that require assistance by others.  The last thing you should do in client intake is shy away from asking about assets or circumstances that raise international and cross-border estate planning issues.  They can only come back to bite the client’s estate (and possibly you) if they are not addressed.  These issues include the following:

  • avoiding accidental foreign trusts
  • spotting needs for carve-outs for non-California assets
  • identifying likely reporting requirement issues that require immediate or future CPA assistance
  • dealing in practical ways with choosing intended beneficiaries and fiduciaries in other jurisdictions
  • identifying and working with professionals in other jurisdictions

The New Attorney Round Tables are presentations oriented towards attorneys with three or less years of experience in trusts, estates and probate, but all are welcome. Presentations are generally held the second Wednesday of each month.
