Medi-Cal Update: More of What's New, What's Not, for the Thirtieth Anniversary of MCCA Draft Regulations

It seems just like yesterday. ACL 90-01 and 90-03 came out as draft regulations to steer us through the Medi-Cal Maze, and notwithstanding the OBRA bill in 1993 and the Deficit Reduction Act of 2005, we are still the Golden State when it comes to transfer laws, and with the recovery reform of 2017, we have made it easier than ever to avoid expensive irrevocable trusts. Our program this year will explore the techniques that still work to expand resources for spouses, use precatory trusts to shield gifts from seniors, and avoid recovery. We'll also touch on some special needs trust issues, including the ambulatory Social Security rules.

SPEAKER BIOGRAPHIES:

Peter S. Stern practices estate planning and elder law in Palo Alto. After teaching history at Stanford and Santa Clara, with a brief foray into government service, he attended Stanford Law School, graduating in 1981. He has served on the Trusts and Estates Executive Committee of the State Bar of California (Chair 2007-8), the Judicial Council Probate and Mental Health Advisory Committee, and the Elder Law Committee of ACTEC, which he presently chairs. He has participated in a number of legislative initiatives, including the conservatorship reform projects and Medi Cal recovery legislation.
