Title: Caring for the Person

Description: Conservators, trustees, and agents are most often tasked with caring for the person as well as the estate of the ward. Yet their attorneys are more often focused on the estate issues as opposed to the personal care issues even though the personal care issues are often the most difficult and volatile issues. Disputes frequently arise over who will provide the care, how much the care will cost, and to what extent the ward’s freedom can be curtailed.

About the Speakers and Moderator:

  • Ann Marshall Robbeloth, JD, MSW, has been working in the fields of Estate Planning, Conservatorship and Elder Law since 1997. She opened her law office in 2005, with the goal of incorporating the unique qualities of each client into the planning process. She uses her legal and cooperative family skills to assist individuals and families to make informed decisions. Ann assists families with probate avoidance and tax planning, incapacity, special needs and elder care. Part of Ann’s practice involves working with families and individuals after the loss of a loved one. Whether assisting parents to plan for the needs of their children, working through options to support a favorite charity, or dealing with life transitions, Ann is willing to listen, explain, and support clients throughout the process. 

    Ann graduated from Santa Clara University with a Bachelor of Science Degree in Political Science and Psychology. She graduated from Tulane University with a Juris Doctor, as well as a Master of Social Work. While at Tulane University, Ann represented juvenile delinquents with the Tulane Juvenile Law Clinic. She also supported the New Orleans Pro Bono Project by grant-writing and receiving funding for a multi-disciplinary training program for attorneys and social workers in the Orleans Parish Family Law Court.
  • Debra J. Dolch is a private professional fiduciary and the principal of Debra J. Dolch Fiduciary Services. She is a graduate of the University of California, Berkeley (BA) and Golden Gate University (MBA). She is licensed as a fiduciary in California and is a registered guardian with the National Guardian Foundation. For over 30 years Debra has been active in the areas of estate administration, conservatorship, trusteeship, and both personal and financial care management. She has provided consulting services to major law firms and financial institutions.
  • Nina Herndon is a certified care manager (CMC) and a California licensed professional fiduciary(CLPF). She is also a registered administrator for residential care facilities for the elderly (Assisted Living and Board and Care facilities). Ms. Herndon is a member of the Aging Life Care Association (ALCA), the Professional Fiduciary Association of California and the American Society on Aging. She was honored to be named “Outstanding Member of the Western Region” by ALCA in 2005, the recipient of the association’s Rose Kleiner Award for Dedication and Service in 2007 and the organization’s President’s Award in 2008. For the last 15 years since she started Sage Eldercare Solutions, she has strived to empower people to make wise eldercare decisions, relieve family caregiver worries and help older adults "live better". 
  • Michael G. Desmarais is an attorney at law and a California Board of Legal Specialization of the State Bar of California certified specialist in Probate, Estate Planning and Trust Law. He is the past president and past trustee of the Silicon Valley Bar Association, a past commissioner of the State Bar of California, Board of Legal Specialization, Estate Planning, Trust and Probate Advisory Commission, and the author of the “Litigation Tools” chapter of the two-volume California Trust & Probate Litigation series (CEB 2005).
