Provisional Remedies in Probate

Estate litigation is perceived by many attorneys to be a growth area because real estate values are such that anyone who owns a house is likely to have a substantial estate, the owners "entitled children" and his "grieving" widow are increasingly at odds as to who should inherit it and current medical care is often leading to our bodies enduring longer and better than our mental faculties. Accordingly, attorneys are increasingly seeing the opportunity to litigate over estates that are large enough to pay their fees.

Successful litigation in this area, however, is usually dependent upon preserving the estate during the pendency of the litigation. What can a hopeful litigant to do to be sure that there will be an estate left over by the time judgment is rendered? How can a surviving spouse or dependent children prevent a claimant from depriving them of support from the estate.
