The California Franchise Tax Board has stepped up its enforcement of trusts that are subject to California income taxation. The rules in California are complex with respect to when, and to what extent, a trust is subject to California income tax. Estate planners should have at least a basic understanding of these rules especially when a trust has California source income. This program will walk through the rules sets forth in the California Revenue and taxation Code and explain how they apply to a series of fact patterns, which are commonly encountered by estate planners, trustees and fiduciaries. The program also will teach you about FTB Legal Ruling 238, which applies when the entire taxable income of a trust is derived from sources outside California and at least one of the non-contingent beneficiaries are California residents. You also will learn about the California apportionment worksheet, which assists taxpayers in computing California taxable income of the trust as required by CR&TC 17743, 17744, and FTB Legal Ruling 238. This is a must attend program for practitioners who are unfamiliar with the rules governing the taxation of trusts in California.
